Child custody/bipolar disorder?
How would having bipolar disorder affect a child custody case….especially if the parent who is bipolar is not under treatment and is invloved in addictive and dangerous begavior and refuses to get help although he/she was diagnosed as bipolar. Would a bipolar diagnosis affect the judges decision on a custody case?
No, bipolar disorder will not affect a judges decision. (It is suspected that 2 out of 3 people have a mental illness and only 1 in 4 seek treatment.) Unless there is documented evidence (by law enforcement and previous court rulings) that the person in question is not capable of making joint decisions about the children, the award will most likely be joint custody with physical placement going to the parent that has the most “stable” environment or shared placement. Homeless is not stable and neither is not having a source of living, whether it is a job or welfare, proof that the parent can provide the basic necessities will be taken into consideration.
When in court, the parent that wants the children needs to win over the judge with an abundance of respect for the judges authority, no outbursts, and an open mind to fairness for all the people involved, especially the children. You don’t want to go in there with a bad attitude and make yourself look like the one with the mental illness, do you?
