Of the 15 states that have the mandate infertility coverage of health insurance policies, only California and Texas have mandates to provide coverage in policies health. - New Jersey – Self-insurers, employers religious, and companies with fewer than 50 employees exemption; group insurance companies and HMOs that cover pregnancy should cover
- New York – Auto-insurance free; group policy should cover testing and diagnosis
- Ohio – Auto-exempt insurers, HMOs to cover basic health care
- Rhode Island – Auto-insurance-free, individual and group policies and HMOs that cover pregnancy should cover
- West Virginia – Auto-insurance free; HMO to cover basic health care
A state mandate to cover means that unless a group company, and in some individual cases, health care insurance is free, some form of infertility coverage be included in the policy. On the other side of the issue is the mandate State to offer, which only means that the insurance company has to offer for sale a policy that includes coverage for infertility, but the company is not required to purchase such coverage.
